Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Kinetic Golf app or website ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Who We Are

Kinetic Golf is an iOS application and associated website operated as an independent product by Jake Askham. For any enquiries, contact us at jake@kineticgolf.co.uk.

3. Eligibility

You must be at least 16 years old to use Kinetic Golf. By using the Service you confirm that you meet this requirement.

4. Beta Access

The app is currently in a closed beta phase. Access is granted at our sole discretion. We reserve the right to revoke beta access at any time without notice. Features, pricing, and availability may change before public launch.

5. Your Account

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information when creating your account.
• You may not share your account with others or use another person's account.
• You must notify us immediately if you become aware of any unauthorised use of your account.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, copy, or extract content from the app
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools to access the Service without our permission
• Misrepresent your identity or provide false information

7. Health & Fitness Disclaimer

Kinetic Golf provides general fitness programming information for educational purposes. It is not a substitute for professional medical advice, diagnosis, or treatment. Before starting any exercise programme, consult a qualified healthcare or fitness professional, particularly if you have any pre-existing medical conditions or injuries.

By using the Service you acknowledge that physical exercise carries inherent risks, and that Kinetic Golf is not liable for any injury, illness, or adverse outcome resulting from use of the training content.

8. Intellectual Property

All content within the Service — including workout programming, exercise descriptions, video content, design, and branding — is the property of Kinetic Golf and is protected by copyright. You may not reproduce, distribute, or create derivative works without our express written permission.

9. User Content

Any data you log within the app (workouts, recovery notes, tee times) remains yours. We do not claim ownership of your personal training data. See our Privacy Policy for full details on how it is stored and used.

10. Subscriptions & Payments

During the beta phase, Kinetic Golf is free to use. When we launch publicly, subscription pricing will be introduced. Payments will be processed via Apple's in-app purchase system and are subject to Apple's terms. We will provide at least 30 days' notice before any paid tier is activated for existing beta users.

11. Termination

We may suspend or terminate your access to the Service at any time if you breach these terms or for any other reason at our discretion. You may delete your account at any time from within the app settings.

12. Limitation of Liability

To the maximum extent permitted by law, Kinetic Golf shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you have paid us in the 12 months preceding the claim.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
